- The image is a low-resolution copy of a publicity photograph;
- The image is being used for informational purposes about the character Mickey Smith in the television programme Doctor Who;
- No more free alternative exists, because the image is of a fictional character and all images of the character will have the same copyright status;
- The use of the image in this article will have no effect on the BBC's commercial use of the image in question.
