Fair use rationale for Lord Voldemort[edit]

This image, Voldemort in Movie 1.JPG, is being linked here; though the picture is subject to copyright I feel it is covered by the U.S. fair use laws because:

  1. No free alternative can exist given the likeness of Voldemort is a trademark and thus protected;
  2. It is a low resolution copy of a movie poster;
  3. The image was released to the media to promote the movie in querstion, Harry Potter 1;
  4. It does not limit the copyright owner's rights to sell the book or the movie in any way;
  5. Copies could not be used to make illegal copies of it, because it is too low-resolution;
  6. As JK Rowling refrains from depicting Voldemort in her books, no original pix are possible, but a picture of his movie version would greatly enhance the article
  7. it shows Voldemort in his disembodied form, thus visually depicting what is said in the corresponding section; the scene is the climax of the 1st HP movie
  8. no free alternatives seem to exist
