Fair use for Ultimate X-Men (story arcs)[edit]

This image, ULTXM65.jpg, is being linked here; though the picture is subject to copyright I (Peregrine Fisher Talk) feel it is covered by the U.S. fair use laws because:

No free alternative can exist given, the likeness of the Ultimate X-Men is a trademark and thus protected;
It is a low resolution copy of a comic book cover;
It does not limit the copyright owner's rights to sell the comic book in any way;
Copies could not be used to make illegal copies of the comic book cover art on another comic book;
The image is significant; it is the cover to Ultimate X-Men #65 which is the first issue to show the new roster on the cover.
