Contested deletion[edit]

This file should not be speedy deleted as bearing an improper license, because... I believe that although it is not open for commercial use, that it maybe used under the fair use rational that 1) There are No free equivalents that I have found that are free, 2) It is not used commercially, 3) It will only be used on the article 2012 Roanoke Obama campaign speech and 4) It was previously published on flickr. --RightCowLeftCoast (talk) 19:52, 3 September 2012 (UTC)[reply]

There doesn't appear to be any real need for the photograph to be used on Wikipedia. Therefore it is not fair use. Eeekster (talk) 20:15, 3 September 2012 (UTC)[reply]
I have received an email from the photographer, giving us permission to use any of the images associated with the 2012 Roanoke Obama campaign speech, and she has sent an email to permissions-enwikimedia.org
How will I know that this has been received?--RightCowLeftCoast (talk) 20:36, 3 September 2012 (UTC)[reply]
Here is what the email that I received contained:

That would be fine with me. I have sent an email to permissions-enwikimedia.org stating that any of my images in my Barack Obama set can be used. The set is at the link below, if there is another that you would prefer to use. All were taken at the Roanoke speech.

(edit conflict) You have to include the @ sign: permissions-en@wikimedia.org, not permissions-enwikimedia.org.
Permission for Wikipedia to use the image is not enough. It has to be made available under a free licence which allows anyone to use it. --Stefan2 (talk) 21:01, 3 September 2012 (UTC)[reply]
It doesn't appear OTRS received this permission. Probably the sender didn't include the @ sign. Magog the Ogre (tc) 02:38, 4 September 2012 (UTC)[reply]
I sent the corrected email address, I will send her a message again.--RightCowLeftCoast (talk) 06:54, 4 September 2012 (UTC)[reply]
Just received the following:

Hi,

I just sent the following email to permissions-en@wikimedia.org. Hopefully that will serve the purpose. I added the last line because my Flickr photos are licensed under Creative Commons. Anyone can use them for non-commercial purposes, which would cover Wikipedia.

Kristi

To whom it may concern:

Re: en.wikipedia.org/wiki/File_talk:Obama_in_Roanoke_Virginia_July_2012.jpg

You have my permission to use the photo www.flickr.com/photos/kristi_decourcy/7565848868/in/set-72157630566180874/

or any other photos in my Barack Obama photoset www.flickr.com/photos/kristi_decourcy/sets/72157630566180874/with/7565837350/

in the Wikipedia article on Barack Obama's Roanoke speech.

Note: my Flickr photos are licensed under Creative Commons, so are available for non-commercial use.

I have redacted the photographers name, otherwise this is what I received word for word.--RightCowLeftCoast (talk) 17:35, 4 September 2012 (UTC)[reply]
It won't do. The "available for non-commercial use" part is not compatible with Wikipedia's requirements. Eeekster (talk) 17:59, 4 September 2012 (UTC)[reply]
I remember, somewhere in my memory, that it was possible for a photographer to release the image only for a specific article, has this changed?--RightCowLeftCoast (talk) 19:38, 4 September 2012 (UTC)[reply]
I have received an additional email from the photographer it reads as follows (name redacted):

I've been following the discussion on the File talk page (http://en.wikipedia.org/wiki/File_talk:Obama_in_Roanoke_Virginia_July_2012.jpg)

They surely don't make it easy, do they?

I added the Creative Commons part, thinking it would make things easier, but that was a misapprehension.

Regardless, you/Wikipedia have a release from me to use any photo in my Barack Obama photoset (www.flickr.com/photos/kristi_decourcy/sets/72157630566180874/with/7565837350/) for the Wikipedia article.

Other than signing this in blood, I do not think it could be any more definite.

This release should be enough, no?--RightCowLeftCoast (talk) 23:54, 4 September 2012 (UTC)[reply]
No. The permission is only for Wikipedia. Permission must be given for someone. See WP:CONSENT for an example of how to do it. --Stefan2 (talk) 00:02, 5 September 2012 (UTC)[reply]
