This image is believed to be public domain under the following criteria;

  • It is created by an anonymous or unknown photographer
  • It is dated 1870.
  • Picture is taken in Canada. Under Canadian Copyright law, the term of copyright is life of author +50 years, which is definately the case.
  • Although it can not be absolutely confirmed that the author has been dead 100 years (as required by the Wikipedia copyright tag selections and US law), it is probable.
  • The image has no commercial value and is useful only for scholarly research.
  • A differently cropped scan of the same original image is posted on the internet by the Welland Public Library.

It is therefore believed that no person or entity has legal rights to this image and is included as public domain.
