Please explain why this tag applies. Was this particular image originally published before 1923? If so, where? If not, why is it in the public domain? Did the author fail to register the copyright? Or did he fail to renew it? Some other reason? Haukur (talk) 15:59, 14 January 2008 (UTC)[reply]

Because it is from the Victorian Era (it was REpublished in 1934 - Firsfron (copied from edit summary by Haukur)
Are you sure that all illustrations in Ernst's book are unmodified works from the Victorian Era (ending in 1901)? Do you have a citation for that? Haukur (talk) 16:07, 14 January 2008 (UTC)[reply]
I have never heard that a citation is needed to "prove" something is in the public domain. The image was created in the Victorian Era; however, I cannot "prove" the image has been unmodified in the past 100+ years, and it seems possible, even likely (because Ernst made collages), to me that the image could have been modified by Ernst. It wouldn't matter if any of the other images in Ernst's book were modified, so requiring that all illustrations in the book have been unmodified (as you state above) is an unnecessary requirement for proof anyway. Still, as I cannot demonstrate that this image did not undergo any revisions, I am reverting myself and adding a Fair Use rationale for the item.
