Benjamin I. Malek,[1] born in Germany, is an arbitrator and tribunal secretary with T.H.E. Chambers[1] in New York, United States. He has honed his skills while working at prestigious magic circle law firms and leading institutions.

His expertise spans a wide range of legal contexts, including commercial, investor-state, and state-to-state arbitration proceedings. Malek has handled matters under various arbitration rules, including those of the ICC, ICDR, AAA, LCIA, SIAC, HKIAC, CPR,[2] IACAC,[3] THAC, ICSID, and UNCITRAL. Additionally, he has participated in ad hoc arbitrations.

Malek has experience working across jurisdictions such as the USA, Latin America, Central and Eastern Europe. His proficiency encompasses both civil and common law proceedings.

Before joining T.H.E. Chambers,[4] Malek formed part of Arbitration team at Big Law and boutique law firms, including White & Case. In these roles, he handled diverse commercial arbitration cases, representing clients from the US and around the world. Malek also played a pivotal role in the case management teams at the esteemed institutions AAA-ICDR and CPR, gaining firsthand experience in administering and coordinating arbitration procedures both domestically and internationally.

His multilingual abilities allow him to handle matters fluently in English, Spanish, French, German, and Romanian[1]. Malek also chairs the SVAMC AI Task Force,[5] which in 2023 conceived the SVAMC Guidelines on the Use of Artificial Intelligence in Arbitration.[6][7][8]
