Fair use of images[edit]

Every time I read the articles about copyright rules with Wikipedia images, it confuses me...so I'll just say it here: I am a friend of Jim Salicrup, and since I created this article, he has sent me several pictures of himself, via email, to be used here. Does this not mean he is the copyright holder, and has thus given me permission to use the images? It would seem so, but every time I upload an image to the page, it is removed. So please tell me what I need to do, what options I need to click, etc., so that the subject of the article may have the picture(s) included that he has requested of me. Thanks for your interest in participating in editing the article, and I apologize if the rules governing images seem somewhat labyrinthine. The first thing you need to do is find out from him what the copyright status of the photos are. Copyright protected images cannot be used except under a claim of Fair Use. Someone who owns the copyright to an image giving you permission to use it does not qualify as Fair Use, and may not be used. Examples of Fair Use include using a low-res poster or screenshot of from a film or TV episode in an article about those things, or a low-res image of a book or magazine's cover in an article about those things.

In addition, Fair Use images cannot be used if a free image (one that's in the public domain or free-licensed, like all the images at Wikimedia Commons are) is available. The one currently in the article is indeed free-licensed. Nightscream (talk) 17:36, 7 August 2009 (UTC)[reply]
