It is not mentionned in this article how the photon energies are selected when k>0. In pratice, we use the cumulative distribution of $F(\xi )$. The probablity that an electron emits a photon with an energy greater than its own total energy is not null. In that very rare case the hamiltnonian is broken and the particle is ejected from the stored beam. Obviously, in average, the energy conservation is preserved.
