File copyright problem with File:Olancha peak.jpg[edit]

Someone wrote these comments here (another friendly editor reverted them, but I thought I would take a moment to address them):

"Is it true that "I created this work entirely by myself", in the case of this image, and did the naked woman depicted give you permission to take it and release it in the public domain? There is a concept known as "personality rights" here in the United States, you know."

The woman in the picture was in a public place, knew that her photo was being taken and, in fact, offered to move in order to enhance the photo.
